Regulatory Framework of the Malta Gaming Authority

Pursuant to the regulatory authority of Chapter 583 of the Laws of Malta, established by the Gaming Act in August 2018, the Malta Gaming Authority (MGA) regulatory framework is crafted around these regulations and directives to ensure that the organisation’s issuance of the Malta gaming license is granted to trusted and legitimate gambling businesses.

The regulatory framework of the MGA ensures that all casino and iGaming activities within Malta and beyond adhere to basic principles, such as:

  • Providing lawful basis for the regulation and control of all gambling activities based in or offered from within the jurisdiction of Malta.
  • Ensuring that all gambling activities are conducted with fairness and honesty.
    Preventing all gambling activities from being associated with criminal activity of any sort.
  • Making sure gaming operators that are licensed by the MGA treat bettors and players with fairness, and that winners will be paid promptly with all transactional information held in strict confidence.
  • Protecting all persons under EIGHTEEN (18) years of age and other vulnerable persons.

Malta Gaming Act - 2018

‘AN ACT to make provision for the governance and regulation of gaming services and products from and within Malta, together with all such activities and matters that are ancillary or incidental thereto or connected therewith, and for the establishment and functions of the Malta Gaming Authority.’

The Malta Gaming Act was enacted by the Government of Malta as Chapter 385 in the Laws of Malta in August 2018. The Gaming Act was created and enacted as a result of the overhaul of the previous Maltese gaming regime’s legislation and regulations, which originally played as a regulator for land-based casinos in Malta and casinos on cruise ships within Maltese territorial waters. Other forms of gambling include lotteries, remote gaming, and skill games with prizes.

The Malta Gaming Act sought to consolidate all gambling-related activities and types under one legislation, and determine the function of a single regulatory body to oversee the gaming industry in Malta, which is the MGA.
